Grandparents Rights and Custody

Grandparents can play an important role in helping raise a grandchild. When the relationship goes from helping to raising the grandchild without help from the parents, that is when a Grandparent should know their rights.
Visitation statutes do not give a grandparent an absolute right to visitation with a grandchild however, in Texas, a court can authorize visitation with the child or a primary custodial relationship with a child if:
1. the parents are divorced
2. the parent abused or neglected the child
3. the parent is in jail
4. the child has lived with the grandparent for at least 6 months
